Purchase Contract

This site is owned and operated by Quality Wines Somerset Ltd (“Quality Wines Somerset Ltd”, “we” or “us”). Registered office: One New Street, Wells, Somerset, BA5 2LA. Registered in England No. 8359796, VAT 319 9447 64.

Please read these Terms & Conditions carefully as they affect your rights and liabilities under the law

All purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date when these Terms and Conditions were most recently updated.

We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the email. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.

All prices are in UK Pounds and are inclusive of VAT where applicable, at the current rate. The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the "checkout" button) subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s) at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.

The price of the goods does not include a charge for delivery.

Although we endeavour to hold stock of all the items advertised for sale on our site this cannot be guaranteed so that by acknowledging receipt of your order we are not creating a binding contract to supply what you have ordered but which we do not have in stock. The content of the site is managed and therefore any products that are out of stock should be highlighted.

In the event of unavailability for whatever reason, we will advise you of our position when we receive your order and we will await your subsequent instructions.

It is with regret, that due to Brexit and the new customs processes, we are currently unable to accept orders from Northern Ireland. We apologize for any disappointment that this causes. We are working on finding a solution, so please watch this space.

The cost of delivery is based on the total weight and or types of the items in your basket.

Our delivery prices are as follows:

• £11.50 for small orders delivered by courier (please note this excludes larger fragile items, please see below*)

• £29.50 for orders containing larger fragile items* - delivered by Palletnetwork

• £39.50 for heavy and oversized items - delivered by Palletnetwork

• Free delivery for orders over £300

*Larger fragile items: some of our larger pots and planters are too large and too fragile to be safely sent via courier. For these items we will opt for pallet delivery as this is much safer and ensures your delivery arrives to you in perfect condition.

Types of delivery

For small orders, we will deliver your item via one of our trusted courier providers. Please note this excludes larger fragile items (as above).

For heavy, large or oversized orders, delivery will be made via pallet delivery provided by our partners at Palletnetwork and you will be contacted before delivery to make appropriate arrangements.

We believe that's it fairer to our valued customers to show real shipping prices, rather than offer "free delivery" and hide the costs within the item price.

We aim to deliver within 5 working days, but please note that this depends on the item and the method of delivery. Once you have paced your order, we will be in touch to provide delivery times and discuss delivery further.

If the delivery time is delayed due to unforeseen circumstances, we will communicate this with you.

Delivery will be made to the address specified at the point of order

We deliver to most addresses within the United Kingdom, including the Channel Islands.

All deliveries require a signature upon receipt, if re-delivery is required a further delivery charge may be payable.

Colour variation

Due to the production method of all planters, the colour may vary slightly from the image shown. MyGardenCentre does accept returns, but please note that the customer may be liable for delivery charges.

Returns and exchanges

We believe you will be delighted with your purchases but there may be occasions when you feel it necessary to return an item. You have the right to cancel the contract for the purchase of any item within seven working days of delivery. This applies to all our products. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is faulty.

Here at My Garden Centre we make every effort to ensure that your items arrive safe and undamaged. However, if you do receive any broken or damaged items in your order we are happy to provide refunds/exchanges. If you have received items that are damaged or broken we ask that you contact us immediately, on the same day as your delivery at stefan@mygardencentre.co.uk and provide photographic evidence of the damage. Failure to comply with this procedure may result in us refusing to refund/exchange your item.

Warranty and Liability:

Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, neither will any of these terms restrict any of your statutory rights.

In addition that outlined above we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.

Other than as set out above, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
